What is a Florida wrongful death claim?
In Florida we have a statute that’s actually called the wrongful death statute. And essentially what it says is this, that if someone is negligent and causes the death of another person that you can bring a wrongful death claim. And what happens is an estate is opened up and you have a personal representative that someone appointed by the court is qualified to speak for the person who’s bringing the wrongful death claim. And it can also be that person, a family member. And then what happens is that claim is advanced on behalf of the person that lost the person that died. In other words, you have to be a relative, you have to be a certain age, so you can be a spouse, a child, and that type of thing. And if you’re over 25 years old, the damages change if you’re a child. So that’s essentially an overview of the Florida wrongful death statute.
