I was injured because of a defect in my bike. What can I do?
First thing you can do is to preserve the motorcycle because it’s the most important piece of evidence. The second thing you can do is to find out if there have been other similar problems with the motorcycle. You can do that through the Consumer Product Safety Commission or you can do that through other databases and find out if that defect has occurred before and how it’s affected other people. You can then sue the manufacturer for producing a defective product. Under Florida law, we have strict liability that if, in fact, the product is defective, then they are responsible and they are legally liable under Florida law to compensate you for your injuries.
