I signed a consent form at the hospital. Does that mean I cannot sue?
The answer depends on, A, the content of the consent form, and, B, what was done. It doesn’t necessarily mean that you can’t sue. Just because you sign a consent form that advises you of a complication, if the doctor is doing a procedure and he violates the standard of care for that particular procedure, the consent form is meaningless. If a doctor does a procedure and does it correctly according to the standard of care and you develop the complications in consent form, then you would not be able to sue.
