How much time do I have to take legal action against the hospital?
Hospitals have special protection under Florida law. They have a shorter statute of limitations, which is two years from the date of the incident or two years from which you should have known that there was medical negligence in the hospital, not to exceed four years unless you can prove fraud. If you have notice on the date that the hospital committed medical negligence, it starts to run two years from that date. If you don’t find out about it until two years afterwards, it can be extended to four years.
