Can I sue my employer if I am burned on the job in Florida?
You can, but it’s extremely difficult because if you sue your employer, they get outside of worker’s compensation, you’ve got to prove that the injury was virtually certain to occur and that your employer knew it. If your lawyer can reach that level, then you can sue your employer, and it’s much better than being in the worker’s comp system where you only get lost wages in medical bills. If you can sue your employer and prove that it’s virtually certain, you then get compensated for pain and suffering, mental anguish, scarring, disfigurement, all those other human damages.
