What options are available to someone injured in a Florida birth injury case?
There are primarily two options available to a baby that’s injured in the birthing process. The first one is called NICA, which has to do with neurological injuries that babies suffer in the birthing process. It is a system similar to worker’s compensation where a baby is guaranteed certain benefits like medical care and treatment but they don’t get compensated as they would in the Tort system, which is the second option.
In other words, if you have a plaintiff’s attorney that has done a lot of these cases he’s going to want that baby not to be in NICA and to be into the regular Tort system because then the child would not only be able to be compensated for future medical care and treatment but also for human damages, the pain and suffering, the inability to lead a normal life, or the incapacity to do so.
