If you’re the person injured, absolutely. If you’re a family member, no is the answer. Many times, people have what they call [decubitus 00:00:14] ulcers in nursing homes. They’re very painful, and depending on the level of the ulcer, the pain and suffering is directly related. Or they have other problems where they have serious injuries. So, again, if you’re the person injured, you can definitely recover for pain and suffering. If that person doesn’t survive, then you’re going to have to bring a wrongful death claim and the answer would be that you can’t recover for pain and suffering. You can recover for your loss, recover for your loss of relationship with that person.
